Terms & Policies
These Terms of Service (the 'Terms') are an agreement between users of the service (the 'User') and the operator providing 'Xnote' (the 'Service').
Article 1. Scope
- These Terms apply to all use of the Service operated by us and any related services.
- For services applicable only to specific members, the conditions displayed by us on the site apply, and those displays are deemed part of these Terms.
Article 2. Use of the Service
- Eligibility
- The Service may be used only by those who comply with these Terms and applicable laws.
- Minors represent and warrant that they have obtained permission from a guardian (legal representative) to use the Service.
- Member registration
- Users may use the Service by creating an account and registering as a member.
- All features of the Service are available free of charge.
- Personal use
The Service is intended for personal use; corporate use or account creation requires separate application and approval.
- Restrictions and removal
The operator may, without prior notice, restrict or delete an account, suspend access to the Service, or delete user content (defined later) in the following cases.
- When these Terms are violated
- When the user becomes subject to a ruling for commencement of guardianship, curatorship, or assistance
- When the user has previously had service use suspended or membership canceled
- When it becomes clear that the user belongs to or is involved with anti-social forces
- Other cases the operator deems appropriate
- Obligations at registration
- You may not provide false personal information.
- You may not create another person's account without permission.
- You may not create multiple personal accounts.
- If your account has been suspended, you may not create a new account.
- Keep your contact information up to date so you can receive emails from the operator.
- You may not share your password or grant account access to others.
- You may not transfer your account to others.
- Manage passwords and other credentials at your own responsibility and keep them confidential.
- If your account is used by an unauthorized party, notify the operator immediately.
- Use by third parties
Even if a member's account is used by a third party, the operator treats it as use by the member.
- Service changes
To provide better features and service, the operator may, without prior notice, change, add to, or stop providing the Service, or impose new restrictions.
- Advertising
The user uses the Service with the understanding that ads may be displayed within the Service, and that announcements and advertisements from the operator and followed companies may be sent to their registered email address.
Article 3. Provision of the Service
- The operator may limit all or part of the Service to users who meet conditions such as age, identity verification, registered information, and any other conditions the operator deems necessary.
- When the operator deems it necessary, the operator may, without prior notice to users, change all or part of the Service or stop providing it at any time.
- To use the Service, the user must, at their own cost and responsibility, prepare any necessary personal computer, mobile phone, communication equipment, operating system, communication means, and electricity.
Article 4. User obligations
- When registering information about themselves to use the Service, the user must provide truthful, accurate, and complete information, and update it to keep it current.
- The user must strictly manage their account at their own responsibility to prevent unauthorized use. The operator treats every action taken using a user's account as an action by the user.
- The user may delete their account and withdraw at any time.
- If the operator determines that a user has violated, or is at risk of violating, the Terms or policy, the operator may, without notice, suspend, delete, or modify the account or take similar measures. The operator is under no obligation to disclose the reasons for such measures.
- An account that has not been used for over a year from the last login may be suspended or deleted, with notice sent to the registered email one month in advance.
- A suspended account can be reactivated by logging in again.
- Once an account is deleted, the user's right to use the Service ends. Even an accidental deletion cannot be reversed.
- A user's account is personal and the right to use the Service may not be transferred, lent, or inherited.

- All copyrights, trademark rights, other intellectual property rights, and other property rights related to the Service belong to the operator.
- All copyrights, trademark rights, other intellectual property rights, and other property rights related to content belong to the operator or the rightful information partners.
- All copyrights, trademark rights, other intellectual property rights, and other property rights related to user content belong to the user who posted the content, or to the third-party copyright holder if the copyright belongs to someone other than the user.
- For user content in which the user holds rights under copyright law, the user grants the operator and any party who succeeds to or is licensed by the operator a free, worldwide license to use the content (including reproduction, public transmission, distribution, translation/adaptation, and sublicensing from the operator to third parties) until the end of the copyright term. The user also agrees not to exercise moral rights of authorship against the operator and parties succeeding to or licensed by the operator.
Article 8. Prohibited acts
- Make secondary use of a third party's work in a way that unfairly harms the rights holder's interests
- Infringe trademark, patent, or other intellectual property rights, the right of reputation, the right to privacy, or any other legal or contractual rights
- Violate laws, court judgments, decisions, or orders, or legally binding administrative measures
- Engage in acts that may harm public order or morals
- Post or transmit excessively violent expression, explicit sexual expression, expression that leads to discrimination based on race, nationality, creed, gender, social status, lineage, etc., expression that induces or promotes suicide, self-harm, or drug abuse, or other anti-social, offensive expression
- Impersonate the operator or a third party
- Intentionally spread false information
- Transfer or lend a Service account to a third party
- Engage in sales, promotion, advertising, solicitation, or other for-profit activity not approved by the operator
- Use the Service for the purpose of meeting or dating people of the opposite sex who are strangers
- Engage in harassment or defamation toward other users
- Provide benefits to or otherwise cooperate with anti-social forces
- Engage in religious activity or solicitation for religious organizations
- Improperly collect, disclose, or provide other people's personal information, registration information, or use history
- Cause trouble for the Service's servers or network systems
- Access the API server outside of the Service
- Use bots, scraping, or other technical means to manipulate the Service in unauthorized ways
- Intentionally exploit defects in the Service
- Make unjust inquiries or demands of the operator, such as repeating the same question excessively
- Interfere with the operator's operation of the Service or with other users' use of the Service
- Violate the terms of service of any contractor used by the operator
- Engage in any other act the operator deems inappropriate
Article 9. Hiding or deleting content
The operator may hide or delete content in the following cases, and is under no obligation to disclose or answer the reasons for these measures.
- When the operator determines that the content may violate the terms of service of the operator's contractor or other commissioned company.
- When the operator determines that the content infringes the rights or interests of a third party.
- When a third party files a rights claim with the operator and the operator deems the claim valid.
- When public agencies, trust verification organizations, internet hotlines, lawyers, etc. point out violations of public order and morals or infringement of third-party rights.
- In any other case where, regardless of whether the content violates the Terms or policy, the operator deems it inappropriate for the operation of the Service.
Article 10. User responsibility
- The user uses the Service at their own responsibility and bears full responsibility for all actions and their consequences in the Service.
- The operator may, in response to actions or grounds that violate the Terms or policy, hide or delete content, suspend, delete, or modify accounts, or take other measures of its choosing. However, the operator has no obligation to monitor, supervise, or prevent violations, nor any obligation to take measures such as hiding/deleting content or suspending/deleting/modifying accounts, nor any obligation to correct violations.
- If the operator suffers any direct or indirect damage from the user's use of the Service, the user must immediately compensate the operator upon request.
Article 11. Exclusion of anti-social forces
- The user represents and warrants that, in the past, present, and future, they do not belong to anti-social forces (which means organized crime groups, members of such groups, persons within five years after ceasing to be such members, associate members, related companies, racketeers, social-movement-feigning racketeers, special intelligence violence groups, and others equivalent thereto), and promises not to engage in violent acts, fraud, threats, business interference, or any other acts that violate or may violate the law.
- If the user violates the previous paragraph, the operator may suspend the user's use of the Service or delete their registration, etc., without prior notice. The operator bears no responsibility for any disadvantage or damage caused to the user as a result.
Article 12. Operator's disclaimer
- The operator does not guarantee any operation of the Service to the user and bears no responsibility.
- The operator bears no responsibility for the completeness, truth, accuracy, legality, etc. of the information provided by the Service.
- The operator does not guarantee that the Service, content, or user content does not infringe the intellectual property or other rights of third parties.
- The user accepts in advance that all or part of the Service may become unavailable due to changes in the content or operation of external services such as Facebook (the 'External Services'), or because the member can no longer use all or part of the External Services. The operator bears no responsibility for any damage caused to a member in connection with the External Services.
- The operator bears no responsibility for any losses caused by acts of God or other force majeure (including, but not limited to, line congestion, line failures, server downtime, etc.).
Article 13. Privacy
- The operator handles the personal information it processes carefully in accordance with the operator's privacy policy.
- By confirming the operator's privacy policy, the user agrees to the third-party provision of user information described therein.
Article 14. Linking with external services
- When using the linking feature with an external service to log in, the user may be asked to permit the operator to access data; the user may use the linking feature only after confirming the content and granting permission.
- For all use of external services, including registration and use of an external-service user ID, the user must follow the terms specified by the operator of that external service.
- When using an external service, the user uses it at their own responsibility, and the operator bears no responsibility for any damages, troubles between the user and the external service's operator or other users, or any other matter related to that service.
Article 15. Changes to these Terms
- The operator may change these Terms by setting the effective date of the revised Terms with a certain grace period, and notifying users in advance — by posting on the site, by email to members, or by any other method the operator deems appropriate — that the Terms will be changed, the content of the revised Terms, and the effective date.
- The operator publishes the revised Terms on the site. If the user uses the Service or the period specified by the operator in the previous paragraph elapses, the user is deemed to have agreed to the revised Terms.
